LAURA IZIBOR AND FRENCH CONNECTION SWEEPSTAKES
2009 OFFICIAL RULES
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
ELIGIBILITY:
Open to legal U.S. residents who are 18 years of age or older and have a valid passport.
Employees of Unique Vacations, Atlantic Records and French Connection (individually
and collectively, the “Sponsor”) and each of their related entities, advertising
and promotional agencies, respective officers, directors and agents (collectively
"Sponsor and its agents") and the immediate family members and persons living in
the same household of each are not eligible.
TO ENTER:
Beginning May 25, 2009, complete the online entry form, found on www.frenchconnection.com/lauraizibor,
between the dates of May 25, 2009 and June 30, 2009 (the “Sweepstakes Period”).
To enter online, beginning 12:00:01 am EST on May 25, 2009, log on to www.frenchconnection.com
(the “Web Site”), complete an official entry form and send it electronically by
11:59:59 PM EST on June 30, 2009. In order for electronic entries to be valid, entrants
must click on the “I Accept” button on the website. Limit 1 entry per person. Duplicate
entries will be void. No mechanically reproduced entries or facsimiles allowed.
Sponsor is not responsible for lost, late, stolen, mutilated, damaged, incomplete,
illegible or misdirected entries. Entries become the property of Sponsor and will
not be returned.
DRAWING:
The potential winners will be selected on or about July 30, 2009 in a random drawing
from all eligible entries received during the Sweepstakes Period. The drawing will
be conducted by Sponsor or its designee, the judge of the Sweepstakes, whose decisions
are final and binding on all matters related to the Sweepstakes. Each potential
winner will be notified by telephone, email and/or overnight mail and will each
be required to complete, sign and return a notarized affidavit of eligibility/liability
and publicity release within 5 days of the date of notification or prize will be
forfeited and an alternate winner selected. If any of the potential winners are
minors in his/her state of residence, following eligibility verification, the prize
shall be awarded to such winner's parent or legal guardian (on winner’s behalf)
who must sign all required documents. Return of a prize notification as undeliverable
will result in disqualification and selection of an alternate winner. A prize certificate
outlining the terms of the prize will be provided by Unique Vacations.
PRIZES AND ODDS OF WINNING:
One winner will be selected and each shall receive one (1) prize packages. One (1)
potential Grand Prize winner shall receive one (1) Grand Prize package which consists
of the following: One (1) 4 day/ 3 night Luxury Included vacation for two (2) adults
to Beaches Resorts located in Turks & Caicos or Jamaica. Airfare is not provided.
These Beaches Resorts include: Beaches Turks Caicos Resort Villages and Spa (Providenciales,
Turks & Caicos); Beaches Negril Resort & Spa (Negril, Jamaica); Beaches Sandy Bay
(Negril, Jamaica); and Beaches Boscobel Resort & Golf Club (Ochos Rios, Jamaica).
The prize will include deluxe accommodations, all meals, unlimited premium brand
beverages, nightly entertainment, all land and water sports, including scuba diving
(for certified divers), snorkeling, gratuities, and transfers to and from the designated
airport. Telephone calls, Red Lane spa treatments and services, specialty dining,
tours & excursions, inter-island transportation, SBUBA Certification courses, island
departure taxes, and purchases made at the Beaches Specialty Shops are not included.
The prize is to be used for purposes indicated above. Prizes must be redeemed for
travel by June 30, 2010 and is not transferable or redeemable for cash. No extension
will be given after the prize has expired. The prize is subject to availability
and selected blackout dates. Reservations will not be confirmed until 30 days prior
to the selected travel date. A processing fee of $25.00 per room, per night, double
occupancy, will apply to each prize. Payment by either check or credit card is to
be made upon receiving hotel confirmation or the reservation will be cancelled.
Beaches Resorts reserves the right to relocate any confirmed prizewinner from their
resort of choice to an alternate resort within our chain based on availability of
space for the secured travel dates. Odds of winning depend on the number of eligible
entries received. Trips must be taken on the dates selected by Sponsor. Minors must
be accompanied by a parent or legal guardian (i.e., if the winner is a minor in
his/her state of residence, the winner’s parent or legal guardian must be the winner’s
guest). Any and all taxes on the prizes, and any other costs, fees, and expenses
not explicitly stated herein are the sole responsibility of the prize recipients.
Prizes are not transferable. Prizes will be awarded. In the unlikely event that
any part of the prize is unavailable for any reason, each winner agrees that Sponsor
has no further obligation to winner other than delivery of the remainder of the
prize, if any. The winner may be issued a 1099 tax form for the ARV of the prize.
GENERAL CONDITIONS:
All federal, state, and local taxes related to each prize package are the winner's
responsibility. Sweepstakes is governed by the laws of the State of New York with
venue in New York County, New York. All federal, state and local laws and regulations
apply. By participating, participants agree: (a) to be bound by the Official Rules
and the decisions of the judge of the Sweepstakes; (b) to release and hold harmless
Sponsor, each of its respective parents, subsidiaries, affiliates, distributors,
suppliers and advertising, promotional and judging organizations and each of their
respective employees, officers, directors, shareholders and agents (collectively
the “Releasees”) from any and all claims, demands, damages, losses or liabilities
(including injury or death) caused by, arising out of, or related to their participation
in the Sweepstakes and/or their use/misuse of the prize; (c) to be contacted by
Sponsor and its agents via telephone, email and/or mail; and (d) if entering via
online ballot, to be bound by Sponsor’s Privacy Policy. By accepting a prize, each
winner consents to the use of his/her name and/or likeness for advertising and promotional
purposes without additional compensation (except if winner is a resident of TN or
where prohibited by law). Proof of mailing does not constitute proof of delivery
or receipt of information to/by Sponsor. Sponsor reserves the right, at its sole
discretion, to disqualify any individual it finds to be tampering with the entry
process or the operation of the Sweepstakes or the Web Site or any web site related
to the Sweepstakes; to be acting in violation of the Official Rules; or to be acting
in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten
or harass any other person. Any use of robotic, macro, automatic, programmed or
the like entry methods will void all such entries by such methods. In the event
of a dispute as to entries submitted by multiple users having the same email account,
the authorized subscriber of the email account used to enter the Sweepstakes at
the actual time of registration will be deemed to be the entrant and must comply
with these rules. Authorized account subscriber is deemed to be the natural person
who is assigned an email address by an Internet access provider, on-line service
provider or other organization, which is responsible for assigning email addresses
for the domain associated with the submitted email address. Each potential winner
may be required to provide French Connection with proof that he/she is the authorized
account holder of the email address associated with the potentially winning entry.
Sponsor may prosecute any fraudulent activities to the full extent of the law. All
federal, state and local laws and regulations apply.
LIMITATIONS ON LIABILITY:
The Releasees are not responsible for any lost, late, illegible, misdirected, mutilated,
incomplete, incorrect or inaccurate entries or entry information, whether caused
by web site users or by any of the equipment, computer hardware or software or any
other technical operation or programming associated with or utilized in the Sweepstakes,
and the Releasees assume no responsibility for any error, omission, interruption,
deletion, defect, or delay in operation or transmission at the Web Site or any web
site related to the Sweepstakes, or for communications line failure, or for theft
or destruction, tampering, or unauthorized access to entries and/or entry information.
If, for any reason, the Sweepstakes is not capable of running as planned by reason
of infection by computer virus, bugs, worms, tampering, unauthorized intervention,
fraud, tampering, technical failures, or any other causes beyond the control of
Sponsor which, in the sole opinion of Sponsor, corrupts or affects the administration,
security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves
the right at its sole discretion to void suspect entries and/or to cancel, terminate,
modify or suspend the Sweepstakes and select the winner from among all eligible
entries received prior to such cancellation, termination or suspension. IN NO EVENT
WILL THE RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND,
INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING
OUT OF YOUR ACCESS TO AND USE OF THE INTERNET SITE www.frenchconnection.com OR THE
PRINTING MATERIAL DOWNLOADED FROM SAID SITES. ARBITRATION/CHOICE OF LAW: Except
where prohibited, entrants agree that (i): any and all disputes, claims, and causes
of action arising out of or connected with this Sweepstakes, or any prize awarded,
or the determination of the winners shall be resolved individually, without resort
to any form of class action, and (ii) any and all claims, judgments and awards shall
be limited to actual out-of-pocket costs incurred, including costs associated with
entering this Sweepstakes but in no event attorney’s fees; and (iii) under no circumstances
will an entrant be permitted to obtain awards for and each entrant hereby waives
all rights to claim punitive, incidental and consequential damages and any other
damages, other than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. All issues and questions concerning
the construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of each entrant and Releasees in connection
with the Sweepstakes, shall be governed by, and construed in accordance with, the
laws of the State of New York, U.S.A., without regard for conflicts of law doctrine,
and all proceedings shall take place in that State.
